Agreement to these terms
These Terms of Service (“Terms”) are an agreement between you and Fodla Media (“Fodla Media,” “we,” “us,” or “our”). They apply to the MINDCREST: IQ MASTERS mobile application, mindcrest.app, and related services collectively called the “Services.” By downloading, accessing, purchasing, or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.
Eligibility and minors
You must be at least 13 to use MINDCREST. If you have not reached the age of legal majority where you live, you confirm that a parent or legal guardian has reviewed and agreed to these Terms. The Services are not directed to children under 13. You may not use the Services where doing so is prohibited by applicable law.
Your account
MINDCREST may begin with an anonymous account and allow you to connect a verified sign-in provider later. You are responsible for protecting access to your account and device and for activity conducted through them. Provide accurate information, do not impersonate anyone, and do not transfer or sell your account. Notify us promptly if you suspect unauthorized access.
Account linking and restoration depend on the identifiers and sign-in providers supported by the current app version. You are responsible for connecting an eligible account if you want progress to be recoverable beyond local device storage.
License to use MINDCREST
Subject to these Terms, Fodla Media grants you a personal, limited, revocable, non-exclusive, non-transferable license to install and use MINDCREST for lawful, non-commercial entertainment and personal cognitive training. You may not copy, distribute, sell, lease, reverse engineer, extract source code, bypass security, scrape, automate, modify, or create derivative works from the Services except where applicable law expressly permits it.
Training results and wellness disclaimer
MINDCREST is a game and personal training experience. Scores, progress indicators, historical estimates, comparisons, and any use of “IQ” are provided for engagement and informational purposes. They are not standardized psychometric tests, diagnoses, medical advice, treatment, educational placement decisions, or guarantees of cognitive improvement. Do not rely on the Services for a medical, psychological, employment, academic, or legal decision.
Virtual items, scores, and leaderboards
Power Points, powers, cosmetics, achievements, streaks, scores, levels, and other virtual items are licensed features with no cash value. They are not property, currency, investments, or redeemable for money. We may balance, correct, limit, expire, or remove them to maintain the Services, address errors, or enforce these Terms.
Leaderboards may show your display name, avatar, equipped cosmetics, and score. Do not use offensive, infringing, deceptive, or personal information in public profile fields. We may remove content or reset results affected by abuse, automation, exploits, or technical errors.
SUPER subscriptions and purchases
MINDCREST may offer SUPER subscriptions or other in-app purchases. The price, billing period, included features, trial terms, and renewal details shown in the app-store purchase screen at the time of purchase control your transaction. Payment is charged by Apple or Google through your store account. Unless stated otherwise, a subscription renews automatically until canceled through your App Store or Google Play account settings before the renewal date.
Refunds are handled under the applicable store’s policies and mandatory consumer law. Deleting the app does not cancel a subscription. Entitlements can require a network connection and a valid store receipt to activate or restore. Features included in a subscription may evolve, but we will not remove already-paid access contrary to applicable law.
Advertising and rewarded experiences
The free version may display advertisements. Ad content is supplied by third parties and does not represent an endorsement by Fodla Media. Where available, you may voluntarily watch a rewarded ad for the reward stated before playback, such as one additional heart. A reward is granted only when the advertising provider confirms completion. Inventory, availability, and delivery are not guaranteed.
Privacy and personalization choices are described in our Privacy Policy and available through Settings → Ad privacywhen required. SUPER is intended to remove in-app advertising while the verified entitlement is active.
Acceptable use
You agree not to:
- Cheat, manipulate scores, exploit bugs, automate gameplay, or interfere with leaderboards.
- Probe, attack, overload, disrupt, or gain unauthorized access to the Services or another account.
- Bypass daily limits, purchase verification, advertising callbacks, security rules, or server-authoritative controls.
- Upload or display unlawful, abusive, hateful, misleading, infringing, or privacy-invasive content.
- Use the Services to violate law or the rights of Fodla Media, service providers, or others.
- Use bots, scrapers, emulators, modified clients, or similar tools to obtain an unfair or unauthorized result.
Intellectual property
The Services—including software, games, visual design, brand names, logos, text, audio, graphics, and arrangement—are owned by Fodla Media or its licensors and protected by intellectual-property laws. Except for the limited license above, these Terms grant no ownership or trademark rights. Feedback you voluntarily provide may be used to improve the Services without obligation to you.
Third-party services
MINDCREST depends on services provided by Google Firebase, Google AdMob, RevenueCat, Apple, Google Play, Vercel, and potentially other providers identified in the app or Privacy Policy. Their services and external links may be governed by separate terms. We are not responsible for third-party content or services beyond what applicable law requires.
Updates, availability, and termination
We may update, maintain, suspend, or discontinue parts of the Services; change game balance or availability; or require a supported app version. Online features can be interrupted by maintenance, network conditions, provider outages, legal requirements, or events outside our control.
You may stop using MINDCREST at any time. We may restrict or terminate access if you materially or repeatedly breach these Terms, create security or legal risk, or misuse the Services. Where appropriate, we will provide notice and an opportunity to appeal. Provisions that by nature should survive termination will remain effective.
Disclaimers
To the maximum extent permitted by law, the Services are provided “as is” and “as available.” Fodla Media disclaims implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. We do not warrant that training will produce a particular cognitive, academic, professional, or health outcome. Nothing in these Terms excludes warranties or rights that cannot legally be excluded.
Limitation of liability
To the maximum extent permitted by law, Fodla Media and its affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, loss of data, loss of profits, or loss of opportunity arising from the Services. Our total liability for a claim will not exceed the greater of the amount you paid to Fodla Media for the Services during the 12 months before the claim or the minimum amount required by applicable law. These limits do not apply where liability cannot legally be limited.
Consumer rights and disputes
Mandatory consumer protections in your country remain unaffected. Before filing a formal claim, please email fodla.media@gmail.com so we can try to resolve the issue. These Terms are governed by the laws applicable to Fodla Media’s establishment, excluding conflict-of-law rules, except that mandatory laws and courts available to consumers in their place of residence continue to apply where required.
Changes and contact
We may revise these Terms as MINDCREST changes. We will post updated Terms with a new effective date and provide additional notice when required. Continued use after an update takes effect constitutes acceptance where permitted by law.
